Hundred and Eighty five came the Plaintiff aforesaid by Daniel Fisher gent his Attorney, and the Defendants not appearing tho' called Therefore on the Motion of the said Plaintiff It is ordered that Judgment be entered for the Plaintiff against the said Defendants for what Damages the Plaintiff hath sustained by occasion of the Testator's non performance of his promise and assumption to be levied of the Goods and Chattels of the the said Testator if so much thereof the said Defts have in their hands to be administered, which Damages are to be enquired of by a Jury, unless the said Defendants shall appear and plead to issue, at the next Court.
At which Day to wit, at a Court held for the County aforesaid at the Courthouse, on Thursday the Twenty second Day of December in the Year last mentioned came the Plaintiff aforesaid by his Attorney aforesaid and the said Defendant not appearing tho' again solemnly called Therefore on the Motion of the said Plaintiff It is ordered that the Order of the last Court be confirmed, and that the Damages be ascertained by a Jury to be impannelled by the Sheriff at the next Court to be held for the said County on the fourth Thursday in January next.
At which Day to wit at a Court held for the County aforesaid at the Courthouse on the fourth Thursday in April One Thousand Seven Hundred and Eighty Six came the Pltff by his Attorney aforesaid, and the impannelling of the Jury aforesaid was continued until the next Court to be held for the said County on the fourth Thursday in the next Month.
