61 July Court 1750

Company of an able Jury who are noways concerned by affinity consanguinity or interest nor liable to any other Just exception to be sumoned by the Sheriff ans sworn before a Justice go upon the Lands in controversy on the second thursday in August next if fair if not the next fair day & survey and lay out the same as either party would have it and as the said Jury shall think fit havig [having] regard to all patents and Evidences as shall be produced by either of the parties and report all matters of fact special by the next Court, and the Sheriff is to remove force if any offered and the surveyor is to return three fair platts and reports to the Clerks office in due time before the day of hearing

In the suit in Chancery between John Hogg and Eleanor his Wife Complts and Isaac Savage and Peter Hegeman Gent Defts came the parties by their attornies and the Complts by their attorney moved that they might prosecute their suit and not give Security according to the former Order made therein which being objected to by the Defts. and the matter put to the Court they are of opinion that the Complts have a right to prosecute their suit without giving security for the Defts. costs where upon Its ordered that they proceed therein. From which Order the Defts prayed an appeal to the Eleventh of the next General Court which is granted them they having entered into Bond according to Law

John Payton & Peter Daniel Gent ordered their dissent to the above order to be entered.

In the suit in Chancery between Edward Hamston Complt. & John Hamston John Short & Richard Bernard Gent Defts. further time is given the Defts. till the next Court to answer the Complt's Bill

In the action of Trespass upon the Case between Pricilla Bows plt & William Burton Deft, the Deft. not appearing Judgment is granted the plt against him and Peter Mauzy his Security for what of the sum sued for in the Declaration shall
