131 September Court, 1751 . Ordered that John Carpenter Pay William Patteson one hundred, & seventy five pounds Tobo. for seven days attendance as an Evidence for him agst. Kirk & Wife.

Ordered that John Carpenter pay Thomas Wood, one hundred & seventy five Pounds Tobo. for seven days attendance as an Evidence for him agst. Kirk & Wife.

In the Ejectione Firmæ between Robert Faldoe, Plt. & Richard Aldoe Deft. for Lands, & Appurtances at the Parish of Overwharton in this County which John Roushel Gent. devised to the Plt. for a Term &c. as is set forth in the Decln. it appearing by the Return of the Sheriff that he had delivered a Copy of the sd. Decln. with the Endorsment to Henry Dawson Tenant in Possession of the Premises upon the sd. Land & he not appearing, it's ordered that unless the sd. Tenant, or those under whom he claims having legal Notice of this Order do appear at the next Court, make him, her, or themselves deft. or defts. in this Cause plead the General Issue confess Lease, Entry & Ouster and do insist only on the Title at Tryal, Judgment shall be given for the Plt. & his Majesty's Writ of Habere facias possessionem awarded the Plt. to put him in Possession thereof

In the Action of Trespass upon the Case between Robt. Brown, & Andrew Grant Plts. & Joseph Waters Deft. the Deft. not appearing Judgt. is granted the Plt. agst. him, & William Sebastian his Security for what of the Sum sued for in the Declaration shall appear to be justly due unless the Deft. do appear at the next Court & ansr. the Plts. Action.

In the Suit on Petition between Henry Studdart, Plt. & Elizabeth Hackney Deft. Judgment is granted the Plt. for two pounds ten Shillings & Costs.

In the Suit on Petition between John Payton Plt. & Samuel Brown Deft. Judgt. is granted the Plt. for one pound fifteen Shillings & Costs. ~

The suit on Petition between Philemon Waters Plt. & Thomas Seddon Deft. is dismist, & the Plt. ordered to pay the Deft. his Costs by him about his Defence in this Suit expended.

Ordered that Thomas Seddon pay John Payton one hundred, & twenty five pounds of Tobo. for five days attendance as an Evidence for him at Suit of Waters.

Ordered that Philemon Waters pay Abraham Farrow one hundred thirty & seven pounds of Tobo. for two days attendance, & for coming, & returning twenty nine Miles once.

Ordered that Philemon Waters pay Henry Norman one hundred thirty & four pounds of Tobo. for two days attendance as an Evidence for him agst. Seddon & for coming & returning twenty eight Miles once.
