of the sd Pltf. his Costs by him about his defence in this behalf expended.
Ordered that John Stacy pay William Byram seventy five pounds of Tobacco for three days attendance as an Evidence for him against Dawson.
Ordered that Henry Dawson pay Nicholas Riley seventy five pounds of Tobo. for three days attendance as an Evidence for him at Suit of Stacy ~
Then the Court adjourned till Court in Course. Richd. Bernard Test Nal. Peyton Clk. Cur.
At a Court held for Stafford County May 12th. 1752
Present } Mott Doniphan, John Peyton, Henry Fitzhugh Francis Thornton, & Thomas Fitzhugh } Gent.
John Stuart Gent. having moved this Court for a Mill on Menesens Run being one of the Branches of [Macotigue?] dams, it's thereupon ordered that the Sheriff summon twelve good & lawful Men of his Bailiwick who being summoned, & sworn are well, & truly to enquire whether building a Mill on the Place proposed by the sd. Stuart may, or will effect [sic] the adjacent Lands of any Person, or Persons, & if it should to value the damages, & report to the next Court.
John Coleman a servant boy belonging to William Kendall adjudged by the Court to be eleven years old which is ordered to be certified.
Ordered that John Payton Constable be summoned to appear at the next Court to answer the Complaint of Thomas Fitzhugh Gent.
Ordered that Hugh King serve his Master Robert Hedges according to Law for fifty days run away time & ninety pounds of Tobacco expended in taking him up.
John Finighan being bound over to this Court by Recognizance appeared & having heard the Evidences against him, its ordered that the Sheriff take him into Custody till he enter into Bond in twenty pounds sterling with two Securities in ten pounds Sterg. each for his good Behavior & keeping the Peace a Year & a day ~
Richard Brooks, Many Brooks, Thomas Brooks, Richd. Brooks junr. Hanah Brooks, Mary Brooks & John Wilson being bound over to this Court by Recognizance, appeared, & having heard the Evidences against them, it's ordered that the Sheriff take them into his Custody till they & each of them enter into Bond in twenty pounds sterling with two Securities in ten pounds Sterling each for their good behavior & keeping the Peace a year, & a day ~
The Action of Trespass upon the Case between James Yelton Plt. & John Payton the younger deft. is dismist the Plt. paying Costs.
Alexander Doniphan, & Michl. Pike came into Court & acknowledged themselves indebted to our sovereign Lord the King in the Sum of ten pounds Sterg. each to be
