229. September Court 1753.

of one Pound eighteen Shillings with Interest thereon from the seventh day of November 1752 till the same is paid.

In the Suit on Petition between Thomas & Robert Dunlops Plts. & Snodall Horton junr. deft. Judgment is granted the Plts. for two pounds three Shillings & eight Pence with Costs, & a Lawyer's Fee.

In the Suit on Petition between William Black Plt. & Joseph Winlock deft. Judgment is granted the Plt. for thirty five Shillings & five Pence half penny & Costs.

In the Action of debt between William Black Plt. & William Bussell deft. the deft. came into Court & confest Judgment to the Plt. for six pounds current Money. its therefore considered by the Court that the Plt. recover the Same of the deft. & his Costs by him in this behalf expended. But this Judgment is to be discharged (the Costs excepted) on Payment of three pounds current Money with Interest thereon from the thirteenth day of August 1752, till the same is paid.

In the Action of debt between William Black Plt. & Merrimond Tiller deft. the deft. not appearing Judgment is granted the Plt. against him & Gerard Fowke gent. Sheriff of this County for what of the sum sued for in the declaration shall appear to be justly due unless the deft.do appear at the next Court & answer the Pls. Action

Ordered that John Lewright pay Andrew McKennan fifty pounds of Tobaccofor two days of attendance as an Evidence for him against Johnson. Present Mott Doniphan Gent.

In the Suit on Petition between Robert Walker Plt. & John Alexander deft.. Judgment is granted the Plt for three pounds nine Shillings & nine pence & Costs.

Ordered that John Alexander pay Thomas Stribling one hundred & seventy five pounds of Tobacco for eleven days attendance as an Evidence for him at Suit of Walker.

Ordered that John Alexander pay Alexander Hardy three hundred & twenty five pounds of Tobacco for the thirteen days attendance as an Evidence for him at suit of Walker.

Joe a negro Boy belonging to Diana Simpson adjudged by the Court to be eleven years old which is ordered to be certified.

In the Action of Trespass upon the Case between Robert, & Edward Maxwells & Compy. Plts & Saml. Whitson deft. the deft. not appearing Judgment is granted the Plts. against him, & Benjamin Strother Gent. his Security for what of the Sum sued for in the declaration shall appear to be justly due unless the deft. do appear at the next Court & answer the Plts. Action.

In the Action of Trespass upon the Case between Robert, & Thomas Dunlops Plt. and William Horton deft. Benjamin Robinson came into Court, & undertook that if the deft. should be condemned in this Action he the sd. Robinson would pay the
