303. July Court, 1754.

Broox deft. the Issue in this Cause to be tried by a Jury is waved & the deft. confessed Judgment to the Plts. for twenty pounds eight Shillings, It's thereupon considered by the Court that the Plts. recover the same of the sd. deft. & their Costs by them in this behalf expended. But this Judgment is to be discharged the Costs excepted on payment of ten Pounds four Shillings with Interest thereon from the first day of March one thousand seven hundred & fifty three till the same is paid.

Ordered that William Howard pay Barton Jackson fifty pounds of Tobacco for two days attendance as an Evidence for him against Mc.Qualty.

Ordered that William Howard pay Lettuce Jackson fifty pounds of Tobacco for two days attendance as an Evidence for him against McQualty.

The Suit on the Attachment obtained by John Foushee Gent. against the Estate of William Walker is dismist & the sd. Walker ordered to pay Costs. Absent Thomas Fitzhugh. ~

Ordered that the Clerk of this County send his Honor the Governor a Scheme held for this twelve Months past, of the Justices holding the Same, with the Names of the several Persons recommended, & such as have not sworn to the last Commission.

A new Commission of the Peace for this Court together with a Dedimus for administering the Oaths Matt Doniphan & John Peyton Gent. pursuant to the sd. Didimus administred [sic] the sd. Oaths to John Mercer, who having subscribed the Test & Abjuration Oath administred the Same to the sd. Matt Doniphan &
