373 } April Court, 1755

In the Action of Trespass Assault, & Battery between Christopher Threlkeld junr. Plt. & John Payton deft. the deft. having pleaded not guilty with leave to give the special Matter in Evidence the Plt. joined the Issue & the Trial is referred till the next Court.

In the Action of Trespass upon the Case between Christopher Threldkeld Plt. & John Payton deft. the deft. having pleaded not guilty with leave to give the special Matter in Evidence, the Plt. joined the Issue & the Trial thereof is referred till the next Court.

In the Action of debt between John Payton Gent Plt. & Francis Day deft. the deft. not appearing upon an Attachment in this Court it's considered by the Court, that the Pll. recover of the said deft. the Sum of five Pounds nine Shillings & two hundred pounds of crop Tobacco & Costs. And the Sheriff having returned the said Attachment executed on a Feather Bed, Horse, & some Lumber, it's ordered that he sell the Same according to Law, & satisfy the above Judgment therewith, if there be Money enough arising by such sale to do the same, & report to the next Court.

In the Action of Trespass upon the Case between John Peyton Gent. Plt. & Joseph Dunaway deft. the deft. not appearing the Judgment against him and Nichloas Dulin, & John Nixon his Securities is confirmed, & a Writ of Enquiry of damages is to be executed the next Court.

In the Action of debt between John Peyton Gent Plt. & Thomas, & William Jordans defts. the deft. Thomas not being taken, it's ordered that a plurias capias issue against him returnable to the next Court.

Withers Conway came into Court & undertook that if the deft. should be condemned in this Action he would pay the Condemnation for him, or surrender his Body to Prison, & the deft. having filed his plea. the Plt. joined the Issue & the Trial thereof is referred till the next Court.

In the suit on Petition between John Stork Gent. Plt. & John Jones deft. Judgment is granted the Pll. for four pounds eighteen Shillings & six pence with
