ties by their attornies [attorneys] and on the motion of the defendant by his attorney It is ordered that the Judgement entered against him by rules in the office be set aside and by his Attorney defends the force and injury when and where &c. and says that he is not guilty of the Trespass Assault and Battery & false Imprisonment as the Plaintiff in his declaration against him hath complained and of this he puts himself upon the country and the Plaintiff likewise doth the same and thereupon came a Jury to wit, James Levingston, John Arthur, Vincent Cromwell, John Hazlerigg, Benjamin Grimes, James Gray, Joseph Hawkins, Benijah Bosworth, Isham Bridges, Daniel Weibel, William Saunders, and Patrick MCullough, who being elected tried and sworn the truth to speak upon the issue joined upon their oaths do say that the Plaintiff is a freeman and not a slave as in pleading he hath alledged [alleged] and do assess the Plaintiffs damages by occasion of the Trespass Assault and Battery and False Imprisonment in the declaration mentioned to one penny besides his costs, Therefore it is considered by the court that the Plaintiff recover against the said defendant the damages aforesaid in form aforesaid assessed and also his costs by him about his suit in this behalf expended and the said defendant in mercy &c. Costs 50/8.
