the plaintiffs were free & given Two hundred pounds or upward in Damages though they were told by the plaintiffs counsel that they must find nominal Damages only, your orators counsel during the Trial tendered several bills of of exception which were sealed & made part of the record & the court having rendered a Judgement on the Verdict aforesaid your orator appealed to the District Court holden at the Sweet Springs, when the judgement of the County Court was affirmed: your orator afterward obtained a Writ of Supersedeas by which means the cause was brought to the Court of appeals who at the October Term last reversed the Judgment of the County Court & that of the District Court and directed a New Trial to be had and your orator presumes that without the interference of this Honorable Court the cause will again be tried in the County Court of Montgomery Where he is well persuaded & verily
