You must produce the Will of Stephen Osborne dcd. to James Osborne when his deposition is taken, and the oath which will be administered to him is this "That that paper is the last Will and testament of Stephen Osborne dcd. who published the same for such as far as he knows & beleives, [believes], that the testator Stephen Osborne was at the time of making and publishing the same of sound mind and disposing memory and that he James Osborne subscribed the same as a Witness in his (Stephen Osbornes) presence and at his request. That he saw the Winesses [Witness] Mark Whitaker and Samuel Alley subscribe the same as Witnesses in like manner with himself, that the names of Mark Whitaker and Samuel Alley is in the hand writing of each, and that Mark Whitaker the subscribing witness is dead and the other subscribing witness Samuel Alley is not an inhabitant of this Commonwealth." Which must be written down in the deposition of James Osborne and Sealed including the Will and this Commission and returned certified by the justices who take the deposition to the Court of Scott. The justices will please insert their names at the head of the Commission They will certify that the deposition was taken before them and where and when.
