to procure other testimony material, and competent for him in the said cause, and cannot now procure such testimony before the end of the present term of said Court - That the testimony of Charles H S West, who resides in Wood County, and State of Virginia, is material, competent, and proper for him in the said cause. and is really wanting from the state of Virginia. That he verily believes the above cause cannot be tried with justice to himself without such testimony, and that he is certain, the testimony of the said Charles H S West can be obtained for the next term of the said Court: That he expects to prove by the testimony of the said Charles H S West, that the late Stephen West, of Prince Georges County Maryland, never made a contract with Charles Jackson, for the manumission of the Complainants in the above cause or any of them as they have in their Bill states. That Stephen West aforesaid regularly paid the said Charles Jackson annually, for his services, all the time he so served him. That the Complainants in the said Cause who were then born were held in the possession and were always claimed by the said Stephen West as his property until by deed of sale for a just and full consideration he conveyed them unto this affiant & one Benjamin Oden, and that the said Complainants have always been owned and claimed by this affiant & said Oden since that time.
