(13) property unto said John S Martin and his heirs against the claims of all persons whomsoever. In Trust; Nevertheless, that if the said Isaac Richmond or his heirs shall on or before the 11th day of March 1826 well and truly pay or cause to be paid, unto Benjamin Estill the just and full sum of two hundred dollars, for which Jonathan Osborn is security in a note to him due the 11th March 1826 together with the expense of drawing and recording this Indenture, then this Indenture to be void. And in further Trust that of the said Richmond or his heirs shall fail to pay the said sum of two hundred dollars on or before the 11th day of March 1826, then it shall be lawful for the said John S Martin or his heirs, executors or administrators to proceed to sell said Richmond's said interest in the above described property at public sale, to the highest bidder, for ready money, before the front door of the Courthouse of Scott, or so much thereof as is necessary, having advertised the time and place of sale twenty days, by putting up an advertisement for that purpose for that space of time at the front door of the Courthouse of Scott County, and out of the proceeds of said sale to pay said Benjamin Estill whatever may be due him of the debt aforesaid, the expense of drawing and recording this Indenture, the expense of sale, and six per cent to said Trustee for his trouble, and the overplus if any to said Richmond or his heirs. And the said Martin doth command with the said Richmond, that he will well and truly execute the Trust hereby reposed in him, and that on said Richmonds paying to said Estill the sum aforesaid and all interest thereon accruing before a sale of the said property or any part of it, together all the above enumerated expense attending this Trust, he the said Martin will at the costs and charges of said Richmond release to him or to his representatives all right in law or equity derived under this indenture.
