Patrick Callahan sworn deposed that after the flogging about 5 o'clock in the evening witness was with prisoner & he saw the negro going up the street the negro seemed to be weak and did not seem to be much affected by the flogging - Murphy gave the negro a drink of Liquor and Murphy and the negro started up 17th St. and after going a while up the street the negro stopped and Murphy pushed him along with a stick & after going about another square the negro sat down again. Prisoner then told witness that he believed the Negro was dying, & asked witness to take care of him, and said he was going to give himself up to the Officers - The negro had handcuffs on him which were taken off when he fell and after the negro fell witness felt his hands and they were cold and the negro was dead. Marcellus Lane sworn and deposed that he saw the prisoner whipping the negro Witness said nothing to the prisoner, but only looked on as he passed. Robert James sworn deposed that he is employed at the Central R. R. and was down where the negro had been flogged. The negro was rolling on the straw and asked witness to do something for him - Witness thought that he was playing Possum -
