to ye fift day of ye next Gennll Court, to be heard before his Exncy their Maties Governor of Virga and ye Honble Councell of State to be held at James Citty. Capt Jno: Withers became Security with ye said Geo: Brent and Robt Brent to prosecute their Appeale.

And now after all which ye Oathes appointed by Act of Parliamt instead of ye Oathes of Alegiance and Supremacie with ye Test being Publiquely read in Court, and tendred to ye said Geo Brent and Robt Brent as aforesaid in Open Court: then they ye said Geo. Brent and Robt Brent prayed Oyer of ye Act of Parliamt that doth enjoyne ye Oathes, and Test as aforesaid, upon them, and if ye Court or any Member of ye Court, have A Dedimus to impower ye Administracon of ye said Oathes, and Test to them. Which being further Considered by ye Court, The Court doe further Say, that as to that, they rest fully Satisfied in their formr opinion that they ye said Geo Brent, and Robt Brent, are obliged to take ye said Oathes and Test, in manner and forme aforesaid, as well knowing that there is Such an Act of Parliamt which Impowers this Court, or any other, to Administer ye said Oathes, and Test unto any one which shall be Informed against as A Recusant & with this Court in ye Jurisdiction [there?]of, without A Dedimus [read?] to them : ffrom which said Judgmt of this Court ye said George Brent, and Robt Brent further not being Content, doth Appeale to ye fift day of ye next Gennll Court to be heard before his Exny, their Maties Governor of Virga and ye Honble Councell of State to be held at James Citty.
