160 Be it known unto all men by thes pnts [presents] that I Mary Thweat the wife of James Thweat of Bristoll parrish in Charles Citty Coun. doe by thes pnts constitute authorize and appoynt nominate and in my place and steed pu[t?] James Anderson my lawfull atturny to acknowledg in the open Court of Charles Citty County my right of Dower in and unto one hundred and ninty acres of land in a conveyance made over by my husband James Thweat and Henry Batt unto Randoll Mattock and off and in three hundred & three acres of land in a conveyance made over by the same parties unto Robert Birchett. And I doe by thes presents ratify and Confirm w'tsoever my sd Atturny shall act in the relinquishing my right of Dower as afforsd. witnes my hand and seal this third of June 1693 Sealed and del'd in pnce [presence] of Mary M Thweat [X] Seal Henry Batt Sam'll Oulton. This Indenture made the third day of June in the fifth year of the reign of our Soveraign Lord and Lady King William and Queen Mary and in the year of our Lord God one thousand six hundred ninty three between Henry Batt and James Thweat both of the parrish of Bristoll in Charles Citty County of the one ptie and Robert Birchett of the parish of Westover in the County afforsd of the other ptie Witnesseth that they the sd Henry Batt and James Thweat for the valluable Consideracon of twenty pounds lawfull mony to them the sd Henry Batt and James Thweat according to agreemt between them well and truely satisfyed and payd wherof and of every part and parcell Wherof the sd Henry Batt and James Thweat doth free quitt releas and discharge him the sd Robt Bircherd his heyrs Exrs & adms. and hath for them and their heyrs given granted bargaind sold aliend assignd over enfeoffed and confirmd and doe by thes pnts fully freely and absolutely give grant bargain sell alien assigne over enffeof and confirm to him the sd Robert Birchett his heyrs and Ass[igns] one parcell of land in the present possession and occupacon of him the sd Robert Birchett wth all the priviledge proffitts and emolum'ts w'tsoever the sd parcell of land containing three hundred and three acres scittuate and lying in the parish of Westover in the County afforsd uppon the head of a branch called Blands Swamp. begining att a little black oke marked four ways at the edge of a little feild formerly cleard and runeth thence South by east two hundred and seventy poles to two Corner markd trees the one being a great Red oke thence West So: West crossing the Blackwater road two hundred and two pole thence No: by West two hundred eighty four pole thence Nor: by east seaven degrees three quarters Northerly to the little saplin black oke first began att. being due by patent granted to the sd Henry Batt and James Thweat by Sr Henry Chichley Knt: Governr of Virga. to have and to hold the sd three hundred and three acres of land and all other the apputns thereunto belonging to him the sd Robert Birchett his heyrs and Ass[ign]s forever in as large and ample manor to all intents & purposes as they the sd Henry Batt and James Thweat or any other might or could enjoy the same. And further they the sd Henry Batt and James Thweat doe for themselves their heyrs Exrs admrs & Ass[igns] covenant promise and agree to and with the sd Robt Birchett his heyrs & Ass[igns] that they the sd Henry Batt and James Thweat is at present rightfully seized of the sd land by an indefeasible title in law and that the sd land is free and cleer and is and shall be warranted and maintayned free and clear from any former bargain sale quitt grant Dower estate title claym or interest made by them the sd Henry Batt and James Thweat or any other person clayming under them or their heyrs or by or with their present consent or procurement: And that the sd Robert Birchet his heyrs or ass[igns] shall peaceably and quietly posses and enjoy all the before recited pr'misses without the lett hindrance or mollestacon of them the sd Henry Batt and James Thweat or their heyrs. in Witnes wherof the sd Henry Batt and James Thweat have hereunto sett their hands and seales the day and year first above written.
