This Indenture made the tenth day of 9ber. [e.g. November] in ye third [y] of ye raigne of our [Sov] Ld, & Lady Wm & Mary by ye Grace of God over Engl [Scott] France & Ireland, King & Queen defenders of ye faith & in ye [y] of our [Lord] one thousand six hundred ninety one between Jno Taylor of [Howerds] hundred in Char City Cou [Gent] of ye one [pt] & Major Jno Stith & James Bisse [Gent] on ye other pt withness [illegible] ye where as [illegible]a certiane act of assembly held [illegible] James City on ye Eighth day of June 1680 [intituled]an act of Cohabitacen & Incorragemt of trade & mame factory ilt is amongst other things Enacted ye fifty acres of land be purchased in [Howerds] hundred for building a towne shore for Char. City County [?horeas] ye [sd] Jno Taylor by Indenture of bargaine & sale beareing date ye third day of february 1690 in Consideracon of ye sum of [soum] thousand [grd] of [Gob]: & Casks to him in hand [ged], as alfoe in Conformity to ye sd act of assembly did give grant bargaine & soll unto Col Edw Hill & Cap James Bisse whoe were ly in this behalfe appointed trusstees so & for ye usse of ye so County of Char Citty fifty acres of land lying & being in [Howerds] hundred only South Side of James River [wch] fifty acres was first lett fourth & staked out along ye River side upwards for [Corath?] into ye open field or passture for bredth, but by reason of missnameing ye Coasts of heaven towards so ch ye [Angth] & bredth doe in truth lie ye bounds of ye pd fifty acres according as they are expressed in ye pd indenture are ambiguous & doubtfull none to ye intent ye same may be oendored certaine & ye bounds there of according to ye true seituacen be plainly [?provessed] & only intend the [assonesdact; of assembly in respect to ye purchas of ye sd fifty [illegible] be fully complyed [illegible] [illegible] ye ye late act of assembly made att James Citty ye sixteenth day of aple last past intituled an At for Ports may be putt in effectuall dascuson for farr as itt related to ye to fify acres of land & to such as have or shall purchas & part lott or [illegible] ye of this [p?ant] indenture further Wittnesseth. Thatt ye pd Jno Taylor in Consideracon of the ten thousand pd of [?ob.} already pd him as of Endl non furthor in hand pd him gy ye pd Jno Stidss & James Bisse, hath given granted bargained & sould & by thefo [p??ence] do this or himselfe & his heires give grant bargaine sell [?sseoff] & conformity unto ye pd Jno Stith & James Biss whoe are on thy behalfe appointed ssooffees in trust to ye up of ye pd County, all ye peace or [illiegible] of land in Howerds hundred afforesd Cout oyning fify acres same more of less [? ing] & being on ye south side of James River over against froin shores by bounded as followeth beginning att ye brink of ye river att a locus stake - Shonezruning through old field or pasture ground up from ye river by a right line [illegible] degrees to ye southward of the southeast passing throwye lower end of sheett spott of old on Frenchee ground called ye old Forte nine hundred seaventy tow fooet & very near four inches to anothers Locus Stake, thou by a right line two degrees to ye westward of ye Southwest two shores and two hundred & fourty foot to one other Locus Stake then by a right line two degrees to ye northward of ye Northwest Nine hundred seventy two foot & four inches or very [near?] there a bouts to ye river & hand [one ne?] ye River side to ye place [illegible] itt [beg?] [illegible] be bounded together with all wayes [?ofem?] proffitts
