140} September Court, 1751.

In the Action of Trespass upon the case between John Champ Gent. Plt. & John Hasty Deft. the Plt for Plea saith that he did not assume the Plt. joined the Issue & the Tryal thereof is referred till the next Court.

In the Action of Trespass upon the Case between Richard Brooke Plt & Nathl. Harrison Esqr. acting Excr. of the last Will, & Testament of William Walker Gent decd. Deft. the Deft. for Plea saith that the Testator did not assume the Plt. joined the Issue & the Tryal is referred till the next Court.

In the Inditement [sic] brought by Mosley Battaley Gent, attorney for our Lord the King in this County against John Stacy the sd. John for plea saith he is not guilty the sd. Mosley joined the Issue & the Tryal thereof is referred till the next Court. ~

Winifred Riley being presented by the grand jury for having a bastard Child & summoned failed to appear whereupon its ordered that she pay to the Church Wardens of Overwharton Parish (for the use of the poor of the sd. Parish) fifty shillings or five hundred pounds of Tobacco & Cask, & Costs.

In the Action of Trespass upon the Case between John Payton Gent & George Waller acting Exers. of the last Will, & Testament of Charles Waller Gent. decd. Plts. & Rawleigh Chinn Deft. The Judgment of April Court last against him, & Benjamin Strother Sheriff of the sd. County is continued & a Writ of Enquiry of Damages is to be executed the next Court.

In the Action of Trespass upon the Case between Richd Barnard Gent. Plt. & John Silva Def't. the Deft. for Plea saith that he did not assume the Plt. joined the Issue & the Tryal is referred till the next Court.
