for four days attendance as an Evidence for him at suit of McCullough.

In the Action of Trespass upon the Case between William Howard Plt. & Richard Hewett deft. the deft. for Plea saith he is not guilty, & hath Leave to give the special Matter in Evidence, the Plt. joined the Issue, & the Tryal is referred till the next Court.

In the Action of Trespass upon the Case between William Howard Plt. & Elizabeth Harris deft. the deft. for Plea saith that she is not guilty, & hath Leave to give the special Matter in Evidence, the Plt. joined the Issue, & the Trial is refferred [sic] till the next Court.

In the Action of Trespass Assault & Battery between Francis Broox Plt. & Darby OCain defent. the deft. for Plea saith that he is not guilty the Plt. joined the Issue & the Trial is referred till the next Court.

Thomas Garner being brought before this Court for Felony, & examined with the Witnesses he is ordered to the Goal [Gaol], for an examining Court on Friday the 22d Instant.

Baily Washington & Moses Lunsford acknowledged themselves indebted to our Lord the King his Heirs, & Successors in the Sum of twenty pounds Sterling each to be levied on their Goods, & Chattles Lands, & Tenements for the use of our sd. Lord the King in Case they fail to appear at the Courthouse of this County on the twenty second of this Instant to give Evidence against Thomas Garner who is committed to the Goal [Gaol] of this County for Felony & do not depart thence without Leave of the Court.

In the Ejectione Firmæ between Thomas [Turff?] Plt. & Henry Fitzhugh deft. for Lands & Appurtenances in the Parish of Overwharton in this County which Henry Tyler demised to the Plt. for a Term &c. as is set forth in the declaration - it's ordered that the Surveyor of the sd. County go on the Land in dispute on the first Saturday in April next if fair, if not the next fair day & survey & lay off the same as either Party would have it, having regard to all Patents & Evidences as shall be offered by either Party, & report all Matters of Fact specially to the next Court, and the Sheriff is to attend the Surveyor to remove force if any offered & the Surveyor is to return three fair Platts to the Clerk's Office in due Time before the Day of hearing. ~ ~

In the Action of debt between Edward Conner Plt. & Darby OCain deft. the deft. not appearing, the Judgment against him & Benjamin Strother his Security is confirmed to the Plt. for four thousand pounds of Tobacco &
