306 } July Court, 1754.

Horton, & Peter Murphy were sworn to try the Issue joined who brought in their Verdict in these Words, "We of the Jury find for the Plt. forty six pounds Virginia Currency, William Dye foreman" which Verdict at the Plt's Motion is admitted to record, & it's considered by the Court that the Plt. recover the same of the sd. deft. & their Costs by them in this behalf expended. But this Judgment is to be discharged (the Costs excepted) on Payment of twenty three pounds of like Money with Interest thereon from the first day of June one thousand seven hundred & fifty two till the same is paid.

In the Action of Trespass upon the Case between Messrs. Grant & Brown Plts. and Alexander Murphy deft. the deft. not appearing the Judgment against him & John Addison his Security is confirmed, & a Writ of Inquiry of damages is to be executed the next Court.

In the Action of debt between Thomas Cummings Plt. & John Thomas deft. by consent of the Parties the Issue in this Cause to be tried by a Jury is waved, & the Matter submitted to the Court, whereupon it's considered by the Court that the Plt recover of the sd. deft. eight hundred & eighteen pounds of Tobacco, & Cask & his Costs by him in this behalf expended.

In the Action of debt between William Black Plt. & Jacob Williams & Nathaniel Harrison Esqr. defts. the defts. not appearing the Judgment against them & Withers Conway their Security is confirmed to the Plt. for eighty pounds, its thereupon considered by the Court that the Plt. recover the same of the sd. defts. & the sd. Withers & his Costs by him in this behalf expended. But this Judgment is to be discharged (the Costs excepted) on payment of forty pounds with Interest thereon from the twenty fifth day of December one thousand seven hundred & fifty two till the same is paid.

The Suit on Petition between Allen McRae Plt. & Saml Angel deft. is dismist the Plt. paying Costs.
