308 July Court 1754.
Richard Gamble, the sd. Arthur produced a Bond of the sd. Richard for fourteen pounds it's thereupon considered by the Court that the sd. Arthur recover the same of the said Richard & his Costs by him in this behalf expended. But this Judgment is to be discharged (the Costs excepted) on Payment of eight pounds twelve Shillings & an half penny, with Interest thereon from the first day of December one thousand seven hundred & fifty three till the same is paid; and the Sheriff returned the Attachment executed in the hands of Andrew Edwards, Andrew Kenny, & John Mercer Gent. who upon Oath declared that the sd. Kenny had in his hands fifteen Shillings Edwards six Shillings which they are ordered to pay the sd. Arthur in part of satisfaction of the above Judgment, & the sd. Mercer declared that he had no Estate of the sd. Gamble's in his Hands.
In the Ejectione Firmæ between James Turff Plt. & John Twigg deft. for Lands & apurtenances in the parish of Overwharton in this County, which William Fitzhugh Esqr. demised to the Pet. for a Term &c. as is set forth in the Declaration, it appearing by the return of the Sheriff that Nathaniel Moore Tenant in Possession of the Prems. hath been duly served with a Copy of the sd. Declaration & Endorsement thereon & he not appearing It is ordered that unless he the sd. Tenant, or those under whom he claims (having legal Notice of this Order) do appear at the next Court, & make him, her or themselves defent. or defts. in this Cause, plead the general Issue, confess Lease Entry & Ouster & do insist only on the Title at Tryal, Judgment shall be granted the Plt.. & his Majesty's Writ of Habere facias possessionem awarded him to put him in Possession thereof.
