{ 309. July Court 1754.

Gerard Fowke Gent: Sheriff of the sd. County for what of the sum sued for in the Declaration shall appear to be justly due unless the defts. do appear at the next Court and answer the Plt's Action.

In the Action of debt between Robert Mannon Plt. & John Brown & Johns Thomas defts. William Rose came into Court, & undertook that if the deft. should be condemned in this Action that he would pay the Condemnation for him, or surrender his Body to Prison, whereupon the defts. prayed Oyer &c. which is granted them.

The Action of Trespass between the Reverd. John Moncure Plt. & Thomas Lemaster & William Potter defts. is dismist the defts. paying Costs

In the Action of debt between William Cunninghame Plt. & James Stuart deft. Stephen Derham, & Elizabeth McAboy came into Court & undertook that if the deft. should be condemned in this Action that they would pay the Condemnation for him, or surrender his Body to Prison, whereupon the deft. prayed Oyer &c. which is granted him Present John Mercer. gent.

In the Suit on Petition between Allen McRae Plt. & James Yelton deft. Judgment is granted the Plt. for two pounds sixteen Shillings & Interest from the tenth day of September one thousand seven hundred & fifty three till paid with Costs & a Lawyers Fee.

In the Suit on the Attachment obtained by William Black against the Estate of Soloman Waugh, the sd. William produced a Bond from under the hand of the sd. Solomon for ten pounds eight Shillings & eight pence half penny, it's thereupon considered by the Court that the sd. William recover of the sd. Soloman the same, & his Costs by him in this behalf expended But this Judgment is to be discharged (the Costs excepted) on Payment of five pounds four Shillings & four pence farthing with interest thereon from the first day of June one thousand and seven hundred & fifty two till paid. And the Sheriff having returned the sd. Attachment executed in the hands of William Garrard who upon Oath declared that he had two hundred seventy & three pounds of Tobacco of the sd. Solomon's in his Hands It's thereupon ordered that the Sheriff sell the same according to Laws & satisfy the sd. William his Judgment therewith if there be enough arising by such sale to do the same & report. ~
