310 July Court, 1754.

In the Action of Trespass between John Tyler Plt. & Elizabeth Sturdy deft. for one hundred pounds sterling by means of the Deft's breaking & entering the Close of the Plt. at the Parish of Overwharton in this County as is set forth in the Declaration, It's ordered that the Surveyor of this County in Company of an able Jury of Freeholders who are no ways concerned by Affinity Consanguinity or Interest, nor liable to any other just exception to be summoned by the Sheriff & sworn before a Justice of the sd. County go upon the Lands in Controversy on the third Friday in August next if fair if not the next fair day and survey & lay off the same as either Party would have it & as the Jury shall think fit, having regard to all Patents & Evidences as shall be produced by either of the Parties, & report all Matters of Fact specially to the next Court. And the Sheriff is ordered to attend the Survey to remove force (if any offered) & the Surveyor is to return three fair Plats & Reports to the Clerk's Office in due time before the day of hearing, & whereas Some of the Lands in dispute lye [lie] in the County of King George, The Parties agree that the Surveyor of this County shall survey the whole. ~

In the Suit on Petition between Withers Conway Plt. & John Brown adminr. of all & singular the Goods & Chattles, Rights & Credits [Stockett?] decd. deft. Judgt. is granted the Plt. for four Pounds one Shilling & four Pence of the Goods & Chattles of the sd. Intestate in the hands of the sd. Intestate in the hands of the sd. deft. if so much he hath in his hands & if he hath not so much in his hands then the Costs of the proper Goods & Chattles of the sd. Administrator

Ordered that William Holdbrook pay Elizabeth McAboy twenty five pounds of Tobacco for one days attendance as an Evidence for him at suit of Fowler.
