and his costs by him in his behalf expended.

In the Action of Trespass upon the Case between Cain Withers Plt. & Presly Cox deft. the Plt. having filed his Replication the deft. hath time till the next Court to consider thereof.

In the Action of Trespass upon the Case between George Bell Plt. & Elizabeth Withers deft. a Jury to wit., William Fitzburgh, Gowry Waugh, Merrimond Tiller Henry Wiggington, William Kendall, Thomas Johnson, Darby OCain, Peter Murphy, John Kirk, John Thomas, Seth Botts, & William Horton were sworn to try the Issue joined who brought in their Verdict in these words "We of the Jury find for the Plt. ten pounds Sterling damage Gowry Waugh foreman" which verdict at the Plt's Motion is admitted to record, & its considered by the Court that the Plt. recover of the sd. deft. ten pounds Sterling damage by the Jurors aforsd. in their Verdict aforsd. assessed & his Costs by him in this behalf expended.

Ordered that George Bell pay Humphry Gaines seventy five pounds of Tobacco for three days attendance as an Evidence for him against Withers.

Ordered that George Bell pay Thomas Spalding forty six pounds of Tobacco for one days attendence as an Evidence for him against Withers & for coming and returning seven miles once.

Ordered that George Bell pay John Tyler seventy four pounds of Tobacco for two days attendance and as an Evidence for him against Withers and for coming and returning eight miles once.

Ordered that George Bell pay Joss Bails seventy five pounds of Tobacco for three days attendance as an Evidence for him against Withers

Ordered that Elizabeth Withers pay John Mauzy fifty pounds of Tobacco for two days attendance as an Evidence for her at suit of Bell

Ordered that Geroge Bell pay John Fitzburgh Gent. fifty pounds of Tobacco for two days attendance as an Evidence for him against Withers ~

In the Action of Trespass upon the Case between Darby OCain Plt. and Isaac Bredwell deft. by consent of the Parties [Seb?] the Wife of Seth Botts her Deposition is to be taken before a Justice

Then the Courd adjourned till tomorrow morning 9.oClock J. Mercer.
