335 November Court. 1754 ~

deft. is renewed.

Then the Court adjourned till tomorrow morning 9, oClock Mott Doniphan

At a Court continued & held for Stafford County 13th November 1754.

Present { Mott Doniphan, John Peyton, Peter Daniel Henry Fitzhugh, & John Washington } Gentlemen

Ordered that Francis Dade be summoned to appear at the next Court to answer to such Things as shall then & there objected against him

In the suit on Petition between Charles Harding Plt. & George Waller deft. by consent of the Parties all Matters in difference between them are referred to the determination of the Revd. John Moncure & John Peyton Gent. & their Award to be made the Judgment of the Court.

In the Suit on Petition between James Stuart Plt. & William Ross junr. Judgment is granted the Plt for one hundred & fifty seven pounds of Tobo. & Costs.

In the Suit on Petition between Robert Boggass Plt. & Richard Rogers deft. Judgment is granted the Plt. for three pounds eighteen Shillings & eleven pence farthing with Costs & a Lawyer's Fee ~ Present John Mercer Gent.

In the Action of debt between Daniel & Alexander Campbells Plts.& Francis Martyn, John Cubbage, & William Heffernon defts. the deft. Cubbage not appearing, Judgment is granted the Plt. against him & John Stuart Gentleman Sheriff of this County for what of the Sum sued for in the declaration shall appear to be justly due unless the deft. do appear at the next Court & answer the Plt's Action. And it is ordered that an alias issue against the sd. Francis Martyn & William Heffernon returnable to the next Court.

In the Action of Trespass upon the Case between John Champ Esqr. Plt. & Soloman Waugh deft. by Consent of Parties the Issue in this suit to be tried by a Jury is waved & the deft. confessed Judgment to the Plts. for eleven pounds nine Shillings & two pence half penny. It's thereupon considered by the Court that the Plt recover the same of the sd. deft. & his Costs by him in this behalf expended.

Ordered that the Sheriff pay George Waller forty nine pounds of Tobacco out of the Fraction in his hands.
