338 November Court 1754.

Alexander Douglass, Nathaniel Price, & Saml. Whiting defts. the defts. prayed Oyer &c. which is granted them.

In the Action of Trespass upon the Case between Andrew Grant Plt. & John Limett deft. the deft. not appearing, Judgment is granted the Plt. against him, & Jacob Johnson his Security for what of the sum sued for in the declaration shall appear to be justly due unless the deft. do appear at the next Court & answer the Plt's Action

In the Action of Trespass upon the Case between Andrew Grant, Plt. & William Thornbury deft. the deft. not appearing Judgment is granted the Plt. against him & Withers Conway his Security for what of the Sum sued for in the declaration shall appear to be justly due unless the deft. do appear at the next Court & answer the Plt's Action.

In the Suit on Scire facias brought by the Honorable William Fairfax Esqr. George William Fairfax, George Washington, Nathaniel Chapman & Augustine Washington Execurs. of the last Will & Testament of Lawrence Washington decd. against William Fitzhugh Gent. the sd. William prayed Oyer &c. which is granted him. ~

In the Action of debt between Whiddon Wallace, Plt. & Simon Perrie, & Thomas Fletcher defts. Thomas Fleeman, & Peter Sidebottom came into Court & undertook that if the deft. Fletcher should be condemned in this Action that they would pay the Condemnation for him, or surrender his Body to Prison, & the sd. Fletcher prayed Oyer &c. which is granted him, & the deft. Perry not appearing, it's ordered that an Alias Capias issue against him returnable to the next Court. William Davis in open Court became Security for the Plts. Costs in this Suit.

In the Action of debt between John Thornton Gent. Plt. & Andrew Crawford, Andrew Kenny & John Minor defts. A Jury to wit John Clark, John Kirk, George Randall William Allen, Thomas Suddon, Edward Pilcher, James Berry, Charles Harding Thomas Crawford, William King, William Burton, & George Bell were sworn to try the Issue joined who brought in their Verdict in these Words "We find for the Plt. nineteen pounds thirteen Shillings & nine pence, & three hundred & forty four pounds of Tobacco Charles Harding foreman" which Verdict at the Plt's Motion is admitted to record & it's considered by the Court that the Plt. recover of the sd. defts. the sd. nineteen pounds thirteen Shillings & nine pence, & three hundred & forty four pounds of Tobacco by the Jurors aforsd. in their Verdict aforsd. & his Costs by him in this behalf expended.

On Motion of John Lewright his Ordinary Licence is renewed ~

Ordered that John Thornton Gent. pay Edward Herndon junr. three hundred & twenty five pounds of Tobacco, & three Shillings for four days attendance as
