341} November Court, 1754

Powell, John Payton, Thomas Spalding, George Randall, John Kirk Merrimond Tiller, John Smith, Rawleigh Chinn, & Alexander Stephens were Sworn to try the Issue joined, who brought in their Verdict in these Words "We of the Jury find for the deft. John Peyton foreman." which Verdict at the defts. Motion is admitted to record, & it's considered by the Court that the Plt. take nothing by his Bill, that the deft. go hence without day & that he recover of the Plt. his Costs by him in this behalf expended.

Ordered that Robert Ashby pay Thomas Seddon two hundred & seventy five pounds of Tobacco for eleven days attendance as an Evidence for him against Bredwell.

The Action of Trespass upon the Case between Charles Harding Plt. & Francis Broox deft. being agreed is dismist.

In the Action of debt beween Charles Stuart & Armaur Plt. & Alexander Douglass deft. the deft. not appearing on Motion of the Plts. by their Attorney an Attachment is granted them against his Estate for fifteen pounds with Interest, & Costs returnable to the next Court.

The Action of Trespass upon the Case between Isaac Fowler, & Rebecca his Wife Plts. & William Holdbrook deft. abates by the deft's. death ~

In the Ejectione Firmæ between James Turff, Pet. & John Twigg deft. for Lands and Appurtenances in the Parish of Overwharton in this County which William Fitshugh Esqr. demised to the Plt. for a Term &c as is set forth in the declaration. John Peyton gent being admitted deft. in the room of the sd. Twigg, pleaded not guilty, confessed Lease Entry & Ouster, and agreed to insist only on the Title at Tryal, the Plt. joined the Issue & the Trial thereof is referred till the next Court.

Twigg pleaded not guilty, confessed Lease, Entry & Ouster, & agreed to insist only on the Title at Tryal the Plt. joined the Issue, & the Trial thereof is referred till the next Court.
