{ 342. November Court, 1754.

In the Action of debt between James Hunter Plt. & Winifred Massey Admrs. [sic] &c of Robert Massey dec'd. deft. the deft. having pleaded Payment & fully Admind. [Administered] the Plt. joined the Issue & the Trial thereof is referred till the next Court.

Gerard Fowke Gent. is appointed Feoffee of Marlbro Town in the Room of Traverse Cooke.

In the Action of Trespass upon the Case between Andrew Grant, Plt. & William Kelly & Phillis his Wife Admrs. &c. of James McIntosh decd. defts. the defts. having pleaded non-Assumpsit & fully Admind. the Plt joined the Issue & the Tryal thereof is referred till the next Court

In the Action of debt between Margaret French Adminx. &c. of Mason French decd. Plts. & Joseph Chrismond, & John Addison defts. the defts. not appearing the Judgment against them & Gerard Fowke Gt. {Gent] late Sheriff of this County is confirmed to the Plt. for six pounds seventeen Shillings & ten pence. It's thereupon considered by the Court that the Plts. recover the Same of the sd. Defts. & the sd. Gerard & her Costs, by her in this behalf expended. But this Judgment is to be discharged (the Costs excepted) on Payment of three pounds eight shillings & eleven pence with Interest thereon from the first day of April one thousand seven hundred, & fifty two till paid. Indorsed on the Bond, rec'd one pound, one Shilling & eight pence

In the Action of debt between William Kelly, & Phillis his Wife Plt. & Nathaniel Price & John Gordon deft. the defts. for Plea say they owe nothing the Plts. joined the Issue & the Trial thereof is referred till the next Court.

In the Action of debt between Robert Mannon Plt. & Benjamin Massey deft. the deft. for plea saith that he owes nothing, the Plt. joined the Issue, & the Trial thereof is referred till the next Court.

In the Action of Trespass between William Garrard Plt. & Saml. Angell deft. the deft. not appearing upon an Attachment ordered in this Suit Judgment is granted the Plt. for six pounds ten Shillings & three pence & four hundred & seventy pounds of Tobacco & his Costs by him in this behalf expended. And the Sheriff having returned the sd. Attachment executed on three Cows, one Calf [,] Corn, & a pair of Cart Wheels, & Grubbing Hoe, & Cow Hide, ordered that he sell the same According to Law & satisfy the above Judgment therewith if there be money enough arising by such Sale to do the same & report to the next Court
