290.} June Court, 1754.

in the Declaration, its ordered that the Surveyor of the sd. County go up[on] the Lands in Controversy on the first Saturday in July next if fair if not the next fair day & survey & lay off the same as either Party would have it, having regard to all Pattents & Evidences as shall be produced by either of the Parties, & report all Matters of Fact specially to the next [Court] and the Sheriff is ordered to attend the Survey to remove force if any offered, & the Surveyor is to return three fair Plats & Reports to the Clerk's Office in due time before the day of hearing.

In the Action of debt between Edward Muse Plt. & Jeremiah Carter deft. the deft. not appearing the Judgment against him & Joseph Carter his Security is confirmed to the Plt. for five pounds seven Shillings & six pence, its thereupon considered by the Court that the Plt. recover the same of the sd. deft. & the sd. Joseph, & his costs by him in this behalf expended.

In the Action of Trespass upon the Case between William Fitzhugh Esqr. & Francis Thornton Gent. acting Execurs. of the last Will & Testament of Gilson Berryman decd. Plts. and Margaret French Adminrx. of Mason French decd. deft. the deft. having pleaded nonassumpsit & fully administered the Plts joined the Issue, & the Trial thereof is referred till the next Court

In the Action of Trespass between Thomas Hornbuckle Plt. & Samuel Grigsby deft. the deft. having put in his demurrer the deft. hath time till the next Court to consider thereof.

In the Action of Trespass Assault & Battery between Gerrard Banks Plt. & Samuel Grigsby deft. the Plt. having put in his demurrer the deft. hath time till the next Court to consder thereof

In the Ejectione Firmæ between Timothy Turff Plt. & Lynaugh Helms def. for Lands & Appurtenances in the Parish of Overwharton in this County which John Mauzy junr. demised to the Plt. for a Term &c. as is set forth in the declaration. It's ordered that the Surveyor of Westmoreland go upon the Lands in Controversy on the seventeenth da of this Month if fair, if not the next fair day, & survey, & lay off the same as either Party would have it having regard to all Pattents, & Evidences as shall be produced by either of the said Partys, & report all Matters of Fact specially to the next Court. And the Sheriff is ordered to attend the Survey to remove force if any offered. And the Surveyor is ordered to return three fair Plats & Reports
