{ 366. April Court, 1755.

At a Court continued, & held for Stafford County 10th April 1755.

Present { Matt Doniphan, John Peyton John Washington, and Baily Washington} Gentlemen.

In the Action of Trespass Assault, & Battery between John Addison Plt. & William Thomas deft. the deft. having pleaded not guilty the Plt. joined the Issue, & the Trial thereof is referred till the next Court.

In the Action of Trespass upon the Case between Cain Withers Plt. & Presly Cox def. the Replication in this Cause is joined & the Trial thereof is referred till the next Court.

In the Action of debt between Robert Ashby, who as well &c. Plt & Henry Wiggington deft. the deft. having pleaded that he owes nothing the Plt joined the Issue, & the Trial thereof is referred till the next Court.

In the Action of debt between Robert Ashby who as well for himself &c. Plt & Abraham Bredwell deft. the deft. for Plea saith that he owes nothing, the Plt. joined the Issue & the Trial thereof is referred till the next Court.

In the Action of debt between Mary Wise Plt. & John Payton deft. the special Verdict in this Cause being argued is adjudged for the deft. It's thereupon farther considered by the Court that the Plt take nothing by her Bill, that the deft. go hence without day & that he recover of the Plt. his Costs, by him about his defence in this behalf expended.

In the Action of Trespass upon the Case between Catharine Ashby by Robt. Ashby her next Friend Plt. & Samuel Bredwell deft. the special Verdict in this Cause being argued is adjudged for the deft. it's thereupon further considered by the Court that the Plt. take nothing by her Bill, that the deft. go hence without day & that he recover of the Plt. his Costs by him about his defence in this behalf expend[e]d.

In the Action of Trespass upon the Case between Sarah McCullough by Joseph McCullough her next Friend Plt. & Saml. Bredwell deft. the Errors in this Cause being argued are adjudged good. It's thereup[on] further considered by the Court that the Judgment given in this suit be reversed, And that the Deft. recover of the said Plt. his Costs by him about his defence in this behalf expended.

In the Ejectione Firmæ between John [Rout?] Plt. and [blank space] for Lands and Appurtenances in the Parish of Overwharton in this Country as is set forth in the declaration, John Waller, by John Peyton Gent. is admitted deft. in the Room
