Hagar vs Idle & Crockett on the motion to dissolve the injunction that came on by consent the trial hearing counsel in opposition thereto doth reject the motion and is ordered that a new trial of the cause determined at the last March Term in the county court of Grayson between said Hagar plt & Frederick Idle defendant be had at the bar of the Superior Court for Washington County & that the papers filed in the said county court of Grayson be removed to that Court and at the Trial thereof the deposition of Charles Binns & John Littlejohn taken at the insistence of the said Frederick Idle & filed among the papers be read in Evidence. And it is further ordered that the defendant Robert Crockett redeliver to Philip Gaines possession of the said Hagar & her children on his entering into and with sufficient leavity in the Clerks office of this court in the penalty of $1500 conditioned to have the said Hagar & her children forth coming to answer & to pay [not?] him as may be thought reasonable the final decree of this court, and the verdict rendered in the case but is to be referred to this court.
