Pursuant to a commission to us directed by the clerk of the Superior Court of law for Giles County Virginia the undersigned Justices of the peace for the county of Harrison and State of Indiana have proceeded this 20th day of August in the year 1830 at the house of William Stephens in the county of Harrison and State of Indiana to take the following depositions to be read as evidence in a suit depending in the Superior Court of law holden for Giles county and State of Virginia wherein Phillis and others who have sued for their freedom are plaintiffs and John of McC. Taylor administrator of James Charleton dec'd and the heirs of said Charleton are defendants. William Stephens of lawful age being first duly sworn deposeth and saith. 1st Question by defendants agents. Are you the son of James Stephens formerly of the State of New York and afterwards of the county of Montgomery and State of Virginia. Ans. I am the Son of James Stephens formerly of New York, and afterwards of Bottetourt which I understand now forms a part of the County of Montgomery Virginia. Ques by same. At what time did your father remove from the State of New York to the State of Virginia. Ans. Forty six years this ensuing fall I think in September.
