County - also the following negroes to wit Amy & her two children Bill and Mary, Ned and Willis, To Have and To Hold the said tracts or parcels of land with all buildings ways improvements & appurtenances of every description whatever to the same in any use belonging or appertaining and the negroes aforesaid, with the future increase of the females thereof unto the said Henry S Allmand his heirs and assigns forever. In trust however and upon the following limits & conditions, That if the said Thomas Williams his executors administrators or assigns shall well & truly pay & discharge the debt aforesaid of five thousand dollars when the same shall become due & payable together with the interest which shall have legally accrued thereon and shall also pay the cost of drawing & recording this Indenture then this Indenture shall be void and the premises and appurtenances aforesaid and the negroes aforesaid shall be released & reconveyed to the said Thomas Williams his heirs or assigns. But if the said Thomas Williams his executors administrators or assigns shall fail or refuse to pay & discharge the debt aforesaid when the same shall become due & payable together with all such interest as shall have legally accrued thereon then it shall be lawful and full power and authority are hereby given to the said trustee to sell & dispose of the estate real & personal herein conveyed at public auction to the highest bidder for ready money after having given fifteen days public notice of the time and place of such sale in some newspaper printed in the Borough of Norfolk and to convey the same to the purchaser or purchasers thereof By good & valid assurances & conveyances whensoever he shall be required so to do by the said William N Ivy his Executors administrators or assigns and out of the proceeds of such sale the said Trustee after having first satisfied & defrayed all the costs & charges necessary to the due execution of this trust shall pay & discharge the full amount of the debt aforesaid or so much thereof as shall remain due and unpaid together with the interest which shall have legally accrued thereon, and of afterwards any surplus of such proceeds shall remain in the hands of the said trustee, such surplus shall be paid to the said Thomas Williams his Executors administrators or assigns, and the said Thomas Williams for himself and his heirs hereby covenants with with the said Henry S Allmand his heirs & assigns to warrant & defend the premises & appurtenances aforesaid against the claim or claims of all & every person or persons whomsoever In testimony whereof the parties aforesaid have hereunto set their hands & seals the day and year first herein before written.
