This Indenture made this thirteenth day of October in the year of our Lord one thousand eight hundred and thirty eight Between Thomas Williams of the County of Norfolk in Virginia of the first part, Wm N Ivy of the same place of the second part and Henry S Allmand who has been mutually chosen by the other parties, their trustee for the purposes hereinafter mentioned of the third part. The said Thomas Williams acknowledge[s] himself to be justly indebted to the said William N Ivy in the sum of five thousand dollars, payable four months after the date hereof to the said William N Ivy his executors administrators or assigns, the full and punctual payment of which said debt when the same shall become due and payable together with interest that shall legally accrue thereon, he the said Thomas Williams is willing and desirous to secure. Now this Indenture Witnesseth that for and in consideration of the premises and of the sum of five dollars to him in hand paid by the said Henry S Allmand at or before the ensealing & delivery of these presents, the receipt whereof is hereby acknowledged he the said Thomas Williams Hath granted bargained and sold assigned transfered and set over and Doth grant bargain and sell assign transfer and set over unto the said Henry S. Allmand the following estate real & personal to wit. a certain tract of land situated in the Parish of Elizabeth River in the County aforesaid which was purchased by the said Williams from Harrison H Banks & Margaret his wife the boundaries of which said tract of land will fully appear upon reference to the deed of said Banks & Wife dated the fifth day of June 1834 and duly recorded in the Court of Norfolk County. Also a certain other tract of land situated in the County aforesaid; adjoining the tract last mentioned purchased by the said Williams from Thomas Hoggard the boundaries of which will fully appear upon reference to the deed of said Hoggard dated Octo: 8. 1834 and also duly recorded in the Court of Norfolk County - also a certain other tract or tracts of land situated in the County aforesaid which was sold by John M Holmes & Wife to the said Williams, the boundaries of which will more fully appear upon reference to the deed of said Holmes & Wife dated the 10 day of June 1835 and also duly recorded in the Court of Norfolk
