To the said John Wills his heirs exors and assigns forever subject however to two previous deeds of Trust [executed] by the said Black to said Wills to secure Michael Hart a debt due and also a Small debt due the said Hart & a debt to Miller & Rucker, and the said David E M Black for himself his heirs and legal representatives doth hereby covenant and agree to and with the said John Wills his heirs Executors admrs & assigns to warrant and forever defend unto the said John Wills his heirs Exors admrs & assigns a good right & title in fee simple to the said Estate real & personal together with the increase of the female slaves aforesaid against the claims of the said David E M Black his heirs & all persons whomsoever subject to the deeds of Trust aforesaid. Upon Trust nevertheless that if the said David E M Black his heirs &c shall fail to pay to the said Burton & Rodes the said Ninety three dollars & Eighty four cents, or any part thereof together with the interest thereon, on or before the 20 Sept'r 1841 it shall in that event be lawful for the said Jn Wills upon being requested so to do to sell the said estate real and personal together with the increase of the female slaves aforesaid or such part or so much of the said estate as he shall think sufficient for the purpose by way of public auction to the highest bidder for ready money having fixed the same time and place of the sale and given the same notice thereof as is required in the two deeds of trust aforesaid and subject to the provisions of the same and out of the money arising from such sale shall after defraying the expenses of this trust pay to the said Bunton & Rodes the said debt of $93.84¢ with any accruing interest or whatever remains unpaid and the surplus pay over to the said Black or his assigns but if the said debt and interest be paid on or before the said 20 Septr 1941 then this Indenture to be void else to remain in full force and Virtue In Witness Whereof the parties have hereunto set their hands and seals the day and year first herein written D E.M Black {seal} J Wills {seal}
