At a Court of Oyer & Terminer held in Frederick County on thursday the 12th. day of June 1806. for the Trial of Negro Harry a Slave the property of James Hathaway of this County on Suspicion of Feloniously Murdering James Stewart, late of the County aforesaid on the 20th. day of May last. Present Cornelius Baldwin, Edward McGuire & George Blakem[an] Edward Smith, and Joseph Tidball Gentlemen Justices - The Prisoner was brought to the barr and Alfred H. Powell Esquire was Appointed Counsel for the Prisoner, Whereupon it being demanded of him whether he was guilty of the felony wherewith he Stood Charged or Not, Said he was in no wise thereof Guilty, and thereupon Sundry Witnesses were examined on Consideration of Whose testimony, and the Circumstances attending the Same, It it the Opinion of this Court that he is Guilty, whereupon it is Ordered that he be hanged by the Neck Until he be dead, and that execution of this Judgment, be Made and done upon him the Said Negro Harry, by the Sheriff of this County on friday the 18th. day of July Next, between the hours of ten in the forenoon, and two in the Afternoon of the Same day, at the usual place of Execution, and this the Opinion of the Court that the prisoner at the bar is of the Value of four hundred Dollars Which is Ordered to be Certified, and thereupon the Said Negro Harry is remanded to Jail.
