In the action of Debt between Jonathan Forward of London merchant plt & Charles Wells & Cartee Wells Defts the Defts having pleaded payment the plt Joined the Issue the trial thereof is [refered?] till the next Court. The action of Debt between Jonathan Forward merchant of London plt & Richard Ashby Snr Deft is dismist. The Suit on petition between Jonathan Forward merchant of London plt & Joseph Cooper Deft is dismist. The action of Trespass upon the case between Hugh Horton plt & Darby Handland & Rachel his wife Defts. abates by the Deft Darby's Death. In the action of Trespass Assault & Battery between Anthony Horton plt & Samuel M Key Deft. on the Defts motion a Special Imparlance is granted him. The action of Trespass Assault & Battery between Darby Handland plt & John Horton, Hugh Horton, William Horton & Anthony Horton Defts. abates by the plts Death. In the action of Debt between Robert Colclough Wm Colclough & Samuel Thornbury Exrs of the last Will and Testament of Rachel Colclough Dec'd plt's & William Conway Deft. the Deft prayed [Cyer?] & which is granted him. In the suit on petition between Daniel Hawkins plt & John Taylor Deft Judgment is granted the plt for one hundred & seven gallons of Cider (which the Court do rate at Sixpence p Gallon) & costs. present James Waugh Abst. Philip Alexander [R Bernard?] In the suit on the attachment obtained by Philip Alexander Gent against the Estate of William Allison, the said Philip refusing to prosecute this Suit, on motion of the said William, he is non Suited & ordered to pay the said William damages according to Law & costs. psent Philip Alexander [R Bernard?] In the suit on the attachment obtained by John Alexander against the estate of John Tracy the said Alexander produced & made oath to an account against the said Tracy for three pounds. It's therefore considered by the Court that the said Alexander recover the Same of the said Tracy and his Costs by him in his behalf expended and the Sheriff having made return that he had attached two beds, Bedsteads, Cords & hides & some bedcloaths & Bolsters one Iron Pott on hooks two Chests, two Boxes, one frying pan, some Bacon, some Corn & some meal some Pewter two Tables one Box Iron & heaters, some Earthen ware & some other Trifling things & attached in the hands of [Faleral?] Hall William Worrel & James McCant & summoned them as garnishees.
