{ 354. March Court. 1755.

Present Thomas Fitzhugh Genl.

In the Action of debt between Charles Stuart & Co Plt. & Thomas Douglass, deft. John Washington, & William Bernard came into Court & undertook that if the deft. should be condemned in this Action that they would pay the Condemnation for him, or surrender his body to prison & the deft. prayed Oyer &c.which is granted him.

In the Action of Trespass upon the Case between Charles Stuart & Co. Plts. & Samuel Earl Adminr. of all & singular the Goods & Chattles of Samuel Earl dec'd. deft. By Consent of Parties the Issue in this Cause to be tried by a Jury is waved & the deft. confessed Judgment to the Plt. for thirty three pounds nineteen Shillings and ten pence. It's thereupon considered by the Court that the Plts. recover the same of the Goods & Chattles of the sd. Intestate in the hands of the sd. Adminr. if so much he hath in his hands, & if he hath not so much in his hands then the costs of the proper Goods & Chattles of the sd. Administrator.

In the Ejectione Firmæ between William Fitzhugh Esqr. Plt. & John Peyton Gent. deft. for Lands & Appurtenances in the Parish of Overwharton in this County as is set forth in the declaration; It's ordered that the Surveyor of this County go upon the Lands in Controversy on the fifth day of May next if fair, if not the next fair day, & survey & lay off the same as either Party would have it, having Regard to all Parties, & Evidences as shall be produced by either of the Parties, & report all Matters of Fact specially to the next Court, & the Sheriff is ordered to attend the survey, to remove force (if any Offered} & the Surveyor is to return three fair Plats & Reports to the Clerk's Office in due time before the day of hearing

In the Action of Trespass upon the Case between John Hooe Gent. Plt. & Winifred Massey Adminrx. of all & singular the Goods, & Chattles, Rights, & Credits of Robert Massey decd. deft. The deft. for plea saith that the Testator did not assume, & that she faithfully administred [sic], the Plt. joined the Issue & the trial thereof is referred till the next Court

Plts. & Winifred Massey Adminrx. of all, & singular the Goods & Chattels, Rights, & Credits of Robert Massey dec'd. deft. the deft. for Plea saith that the Testator did not assume & that she hath fully administred, the Plt. joined the Issue & the Trial thereof is referred till the next Court.
