{ 358 March Court, 1755

Joseph, a negro Man slave belonging to Gerard Fowke who was committed to the Goal [Gaol] of Stafford County by a Mittimus under the hand of Mott Doniphan Gent. one of his Majesty's Justices of the Peace for this County for feloniously burning the House of the sd. Gerard was led to the Bar in Custody of the Sheriff & thereupon Mosely Battaley Gent. deputy Attorney of our Sovereign Lord the King brought an Indictment into Court against the sd. Joseph in these words, Be it remembered that on the second day of April in the year of our Lord one thousand seven hundred & fifty five, Mosely Battaley Attorney of our sovereign Lord the now King in the County aforsd. especially appointed comes into Court, & gives the Court here to understand & be informed that a negro man slave named Joseph belonging to Gerard Fowke Gent. of the sd. County of Stafford did on the twenty sixth day of February in the Year of our Lord one thousand seven hundred and fifty five at the parish of St. Pauls in the aforsd. County of Stafford with force & arms feloniously, wickedly & maliciously burn & destroy the dwelling house of him the sd. Gerard Fowke, then and there being, & other Enormities the sd. Joseph to him the sd. Gerard Fowke then & there did, against the Peace of our sovereign Lord the now King his Crown & Dignity. And thereupon the sd. Joseph was publickly arraigned, & pleaded not guilty & for Trial thereof put himself upon the Court, whereupon immediately then & there the Witnesses were examined in open Court, who being fully heard as well as what the sd. Joseph could alledge in his defence, the Court do adjudge that the sd. Joseph be acquitted of the said Indictment. Mott Doniphan

At a Court held for Stafford County by virtue of a Commission of Oyer & Terminer the 2d .day of April 1755 }

A Commission of Oyer & Terminer for the Trial of Joseph a negro man, Slave belonging to Gerard Fowke Gent. together with a dedimus for administring [sic] the Oaths, John Washington, & Baily Washington Gentn. pursuant to the sd. Dedimus administred [sic] the Oaths to Mott Doniphan Gent. who having subscribed the Test, & Abjuration Oath administred the sd. Oaths to the sd. John Washington Baily Washington, John Peyton, & Peter Daniel Gentln. who subscribed the Test, & abjuration Oath.
