363 April Court 1755 In the Action of debt between Richard Tristoe Sen. Pet. and John Kirk def. a Jury to wit. William Northcut, William Allen, John Peyton, William Russel, James Oneal jun. John Toby, Spencer Bashaw, Mundaill Coy, Samuel Mitchell, Richard Randall, William Mills and Jacob Johnson were sworn to try the Issue joined who brought in their Verdict in these Words, "We of the Jury find for the Pet. nine pouds, six shillings and six pence William Allen foreman" which Verdict at the Pet's. motion is admitted to record and it's considered by the Court that the Pet. recover of def. the sum of nine pouds six shillings and six pence by the Jurors afors. in their Verdict afors. assessed and his costs by him in this behalf expended In the Ejectione firma between Maximillian Robinson Gent. Pet. and John Ralls def. for Lands and Appurtenances in the Parish of Averwharton in this County as is setforth in the declaration. It's ordered that the Surveyor of this Couty go upon the Lands in Controversy on Monday the nineteenth of next Month if fair if not the next fair day survey and lay of the same as either party would have it having regard to all patents and Evidences as shall be produced by either of the Parties and report all matters of fact specially to June Court and the Sheriff is ordered to attend the survey to remove force (if any offered) and the Surveyor is ordered to return three fair Plats and reports to the Clerk's Office in due time before the day of hearing In the Action of Trespasss Assult and Battery between Francis Brooc Pet. and Darby Ocain def. a Jury to wit. Cain Withers, John Fitzhugh, James Berry, John Short, William Johnson, John Waller, William Mathony, John Mason Alexander Donipham, Husband forte Whiteston, Robert Mannan and John Kirk were Sworn to try the Issue joined who brought in their Verdict in these words "We of the Jury find for the def. which Verdict at the defts.
