At a Court held for the County of Grayson on the 23rd. day of May 1810.

On the motion of Frederick Idle by his attorney. It is ordered that the said Frederick Idle be admitted the only Defendant in an action of trespass assault and battery and false imprisonment brought by Hagar a slave against Philip Gaines in this Court, agreable to an Order made by the Chancery District Court of Staunton, at March term 1809. to admit the said Idle in case the suit brought by the said Frederick Idle against the said Philip Gaines for detaining the said Slave should be determined in favour of the said Idle; and it appearing to the satisfaction of the Court that the said suit had been decided in favour of the said Frederick Idle in the Superior Court for Montgomery County at the last term; And thereupon the said Defendant filed his plea in writing to which the plaintiff by her attorney replied generally, and the Judgment entered in the Clerks office is se aside. And on request of the plaintiff by her attorney the trial of this cause is defered till next term.
