James Anderson & George Keith made oath before me James Bradley a justice of the peace for said county that the statements made in a certain paper purporting to be a bill of exceptions to the opinion of the court refusing a trial of the issue directed by the Chancellor to be tried in the Superior court of Law of this county in the case Hagar vs. Idle and also purporting to contain the substance of what each of the said witnesses would have proved before a jury. That the said statements so far as it relates to the evidence which each of them would have given before a jury is true and that each of them would have made the said statement in the said paper attributed to each of them or in substance the same if they had been called on to give evidence at this term in the said cause between Hagar and Idle in which they were summoned as witnesses for the deft.
