Brooks Exor v Brooks Admor } This cause came on again to be further heard upon the papers formerly read and the report of Master Commissioner Bryce made in pursuance of the decree made in this cause on the 25th day of April 1843 with the no exception thereof and offer [illegible] and was argued by Counsel on  consideration whereof it appearing from said Report that the Deft James M Payne Exor of Thomas Brooks has received of the assets of the estate of his Testator a sum more than sufficient to satisfy the decree made in this cause on the 25th day of April 1843 against the said James M Payne as Exor of Thomas Brooks in favour of the deft Meshack Hickes admr of the estate of Fielding Brooks. The Court both adjudge order & decree that the same James M Payne do pay to the deft Meshack Hickes admr of Fielding Brooks the sum of $400 with interest thereon at the rate of six percent per annum from the 23d day of May 1825 till paid and that the said Deft James M Payne out of the estate of his Testator in his hands to be administered do pay to the deft Meshack Hickes admr of Fielding Brooks his costs expended in the defence of this suit.
