To have and to hold the said three negroes to the said Noblet Herbert In Trust, however, for the following uses and none other, that is to say to the use of the said Elijah Chenault his executors and administrators until a sale be made thereof, under the authority of this Indenture:  But should the said Elijah Chenault his executors or administrators fail to pay the said sum of Five Hundred dollars with interest in Twelve months after date and in all things fulfill this Trust Then the said Noblet Herbert his executors or administrators when required to do so by the said Thomas Milbourn his executors or administrators given of one weeks previous notice of the time and place of sale in one of the Alexandria Newspapers shall proceed to sell the said negroes or such of them as will pay said debt with interest & [illegible] at public auction for cash and [illegible] of the proceeds of the said sale pay first the expense thereof then the said sum of Two Hundred dollars with the interest that may be due thereon and if any balance remain in his or their funds pay the same to the said Elijah Chenault his executors administrators or assigns.  It is expressly understood that the said Noblet Herbert his heires executors or administrators are not in any manner or way to be liable for the said property titl he or they make sale of the said negroes or any or either of them they being by this Trust in possession of said Chenault  Then on the further trust and confidence, that the said Noblet Herbert his executors or administrators shall on the request, and at the costs and charges of the said Elijah Chenault or his representatives, reconvey to him or them, and and singular the said negroes Polly Peter Francise and Mussaline whenever the said Elijah Chenault shall in all things have complied with give [illegible] this Trust in the payment of the said sum of Five Hundred dollars with all the interest that may be due thereon in twelve months after date and his heirs thereby covenant as well with the said Elijah Chenault his heirs, executors, and administrators, as with the said Thomas Milbourn that he and they will well and faithfully execute and fulfil the several trusts hereby created.  And the said Elijah Chenault his heirs, executors and administrators, covenant, promise, and grant to and with the said Noblet Herbert his heirs, executors, administrators and assigns, that he the said Elijah Chenault and his heirs shall and will from time to time, and at all times forever hereafter, at the reasonable request and, and at the costs and charges of the said Thomas Mibourn or Noblet Herbert them or either of them executors & administrators make, do and execute, or cause, or procure to be made, done and executed, all and every such further and other lawful and reasonable act and acts, thing and things, conveyance and assurance in the land whatsoever, for the further better and more perfect granting, conveying and assuring all and singular the said negroes hereby granted the said Noblet Herbert his executors & administrators as counsel learned in the law, shall reasonably advise in the perfecting of the title granted.  And lastly that the said Elijah Chenault and his heir the said negroes & each of them hereby granted unto the said Noblet Herbert his executors and administrators against the claim and demand of the said Elijah Chenault and his heirs, and of all and every person or persons, Whatsoever shall and will warrant and forever defend by these presents ...
