At Albemarle November Court 1760 Phoebe an Indian Plt. vs Wm. Fitzpatrick Deft } In assault & Battery & false Imprisonment This day came the parties by their attornies and thereupon came a jury, to wit, William Cabell, Abraham Childers, John Parke, John Lewis, John Watkins, Charles Cobb, Thomas Ballou, Richard Oglesby, John Howard, William Walton, James London, Thomas Martin who being elected tried and sworn the truth to speak upon the issue joined upon their oaths do say that the Defendant is guilty of the Assault, and Battery, and false Imprisonment in the Declaration mentioned in manner and form as the plt. ag't him hath complained and they do assess the plaintiffs damages by occasion thereof to five pounds, besides her costs. Therefore it is considered by the Court that the plt. be restored to Liberty and recover against the Deft. his damages afores'd in form afores'd assessed, and her Costs by her about her suit in this behalf expended & the s'd.
