But should either of the children die without a lawful heir as is in this Item named, my desire is that it go to the surviving children of My brother James P Vass & the lawful heirs of their bodies forever. Item 5th I Give and bequeath unto my Sister Apphia Ewing s Two Children My Interest in the Burch Creek tract land which may be a comeing to me In consequence of the death of my sister Ann to them and the lawful heirs of their bodys forever. But should either one of them die without a lawful heir of their body my desire is that it Go to the surviving brother or sister if both them should die without such an heir as is named in this Item my wish and desire is the Legacy that is bequeathem to them be put out at Interest & my sister Apphia to draw the said Int during her life and after her decease to be equally divided between the children of my sister Elizabeth Shapard & the children of my brother James P Vass to them & the lawful heirs of their bodys forever. Item 6th I Give and bequeath unto my Sister Apphia s two children all my Interest in the Danville Lots belonging to the Estate of my fathers upon the same terms as named in Item fifth Item 7th I Give and bequeath unto my niece Mary E Carter one small walnut desk half dozen silver table spoons & half dozen silver tea spoons, also to her sister Emily B Shapard & their sister Martha T Shapard a feather bed & furniture to each them two to them and the lawful heirs of their bodys forever. Should either one of the named sisters die without a heir as I have herein made mention of my desire is that her property be divided between the surviving sisters to them & their heirs forever the property named in this Item bequeath to my three nieces is now in possession of my sister Elizabeth Shapard which I have a true List of besides a ballance of property on the list which is not in this Item named. My wish & desire is that the property bequeath to my nieces & all the remainder which my list calls for and at this time is deposited by me with my sister Shapard to remain with her during her life & the ballance of the property which is on the list to go to Mary E Carter & to the lawful heirs of her body forever. Item 8th I Give and bequeath unto my neice Elizabeth W Ewing half dozen silver table spoons half dozen silver tea spoons, my silver sugar tongues my sugar cutters my Box China containing forty five peaces, one tea waiter, one large black walnut folding table & one bed & furniture the said silver spoons bequeathed unto Elizabeth W Ewing is Mark PEV to her and the lawful heirs of her body forever; if She should die without a lawful heir of her body the said property is to go to her Brother Thomas W Ewing & his heirs forever Item 9th I Give and bequeath unto Thomas W Ewing my nephew my desk & book case & library books my silver watch, my shot gun, my violin & all the ballance of my property now in the possession of my sister Apphia Ewing which I have a true list of, to him and the lawful heirs of his body forever.
