The deposition of Philip Howerton taken at the tavern house of Nathaniel Poindexter at Halifax Court House in the County of Halifax on the 23d day of August 1841 between the rising & setting sun of that ay according to notice duly given to be read as evidence in a suit now pending on the Chancery side of the Circuit Superior Court of Law & Chancery for Halifax County in which Eliza M Bennett adm'x of Abner C Shelton and John R Bennett adm'r in right of his wife are plaintiffs & Francis L Royall is defendant. This deponent being first sworn according to law deposes and says. There was an execution in the hands of David N Harris in favor of Mary Brown to A. C Shelton for cost the amount of which I have paid over to sd Browns [reposinlation?] the signature of sd David N Harris to the rect dated 15th July 1837 for $5.60 rec'd of Fr. L Royall is in the hand writing of sd David N. Harris. P. Howerton The foregoing deposition was taken subscribed & sworn to before me a justice of the peace for Halifax County at the time & place in the Caption mentioned.
