Came the defendant Samuel Mitchell admor of James Flanagan decd, and put in his answer to the foregoing amended bill of the plaintiff, which answer with the proof thereof is in these words (Here copy 5) And afterwards to wit at Rules holden in the Clerks Office of the Said Superior Court of Chancery on the 27 day of September following On the motion of the plaintiff by Counsel, this Cause was set for hearing as to the defendant Samuel Mitchell. The following are the examinations of witnesses taken and filed in the foregoing Cause (Here copy leaving out the Captions & Certfs. Nos.6: 7: 8, 9:10 then say The following is the paper referred to and annexed to the foregoing deposition (Here copy 11) , then Copy 12, 13, 14, 15, 16 then say The following is the paper marked A referred to and annexed to the foregoing deposition of Epaphroditus Y. Wimbish (Here copy 17.) then Copy 18 heading it thus The deposition of Samuel Mitchell (the date when taken not mentioned) saith after &c.) and then say upon the back of the foregoing deposition of Samuel Mitchell is the following objection (Here Copy it). The following are the Other exhibits filed in the foregoing Cause (Here Copy 19 20. [)] And afterwards to wit At a Superior Court of Chancery holden at the said town on the 17th day of May 1826 (Here Copy order without the names No 3 page 95. [)] And afterward to wit.
