money arising from such Sale, after paying the Costs & Charges of drawing and recording this Indenture, as also all other Expenses which shall attend the said Sale to pay to the said Rives Higginbotham & Co. or their legal Representatives, the said Sums of money with Interest as aforesaid, or such part thereof as shall then remain due, & unpaid, and the Surplus if any to the said William North, or his legal Representatives. And the said William North, for himself and his Heirs doth hereby covenant with the said Caleb Tate Sen'r: his Heirs & assigns, that at the Time of executing this Indenture he is seized of a good, sure, indefeasible, and unencumbered Estate of in and to the said Negroe Slaves, and that he & they shall and will warrant and defend the same to the said Caleb Tate his Heirs or assigns, against the Claims of all persons whomsoever and that in Case of a Sale he will bring forward the said Negroes to the place appointed, & will render to the purchaser or purchasers thereof quiet, and peaceable possession of them, or such of them as may be sold, and will at any Time execute any Deed or other Instrument of Writing which may be devised, or advised, the better to secure his or their Title, or Titles therein.
