This indenture made and entered into this 9th day of April 1829 Between Thomas M. S. Mitchell at the one part William H. Dandridge of the Second part and Robert T. Dunaway of the third part all of the County of Lancaster. Witnesseth that whereas the said Mitchell stands Justly indebted to the said Dandridge in the Sum of Three hundred twenty three Dollars & twelve cents by bond bearing date the 9th day of April 1829 and whereas he is willing and desirous to Secure the payment thereof now this Indenture witnesseth that the said Mitchell for and in consideration of the premises as also of the Sum of one dollar to him in hand paid by the said Dunaway the receipt whereof is hereby acknowledged hast and do by these presents make over Convey and Confirm unto the said Dunaway his heirs and assigns forever the following Negroe slaves to wit. Mima Louisa Henry & Opie, To have and to hold unto him the said Dunaway who acts as trustee herein his heirs and assigns forever. Upon this Special trust nevertheless that if the said Mitchell shall fail to pay off and discharge the said bond and all Interest thereon when demanded by the said Dandridge his heirs or assigns then and in that case it Shall and may be Lawfull for the said Dunaway at the request of the said Dandridge to sell at public auction the befor named negroes or so many thereof for cash as may be sufficient for the purpose aforesaid by advertising the same at least ten days notice and out of the monies arising therefrom first pay all costs and charges attending the sale then the said bond and all Interest thereon and the surplus if any pay over to the said Mitchell or his representatives. But in case the said Mitchell shall pay off said bond and Interest when demanded by the said Dandridge then and in that case this (deed)
