In the Circuit Superior Court of Law and Chancery for the County of Middlesex April term 1845 Judy Wood[,] George Butler[,] Lucy Butler[,] William Butler[,] Mary Butler[,] Martha Wood and Abram Wood plts Vs Elliott Gardner admor de bonis non with the will annexed of Nancy Watts decd George Wright executor of Rich'd Claybrook dec'd George Saunders admor of John Watts and Lewis B Seward admor of Charles Watts dec'd deft } In Chancery This Cause Came on to be heard upon the bill answer and exhibits and was argued by Counsel on Conservation whereof the Court without deciding any principal involved in the Cause doth order this the defendant George Wright Exor of Rich'd Claybrook dec'd do render before a Commissioner of this Court an account of the transactions of his testator as exor of Nancy Watts dec'd That the defendant Lewis B Seward admor of Charles Watts dec'd do render before the said Commissioner an account of the transactions of his intestate as admor de bonis non of the said Nancy Watts, that the defendant George Saunders admor of John Watts do render before the said Com'r an account of the transactions of his intestate as admor de bonis non of the said Nancy Watts and that the defendant Elliott Gardner admor de bonis non of said Nancy Watts, do also render an account of his transactions as admor, he making up their accounts the said Commissioner is authorised to receive as prima facia Correct, any account which may have been settled of the said defendants before Commissioners of the County Court and admitted to record which several accounts the said Commissioners will audit state and settle and report the same to the Court with any matter specially stated deemed pertinent by himself or required to be so stated by any of the parties[.] In making up said accounts the said Commissioner is directed so to state thereunto to show what portion of the funds coming to the hands of the several representatives of Nancy Watts are the proceeds of the hires of the complainant and what portion was received from other sources and also to distinguish between hires accruing since the institution of this Suit and those previously due and the Commissioner is authorised to examine the parties in Solemn form upon interrogatories touching the subject matter of said accounts[.] A Copy Teste James E Healy D.C.M.C.
